Terms of Service
Effective October 22, 2026
These Terms of Service (“Terms”) are an agreement between you and NanoLabs AI (“we”, “us”), the operator of Nano. By using Nano, including by texting it or using nanobot.sh or app.nanobot.sh, you agree to these Terms and to our Privacy Policy.
1. Eligibility
You must be at least 13 years old to use Nano. If you are under the age of majority where you live, you may use Nano only with the permission of a parent or guardian who agrees to these Terms. You must be at least 18, and old enough to form a binding contract where you live, to use Nano’s wallet or buy crypto. You must have the right to use the phone number, Google account and payment method you connect.
2. Invite-only beta
Nano is an early, invite-only beta. Features may change, be limited or stop working, and we may limit usage. Some features, including the wallet and crypto purchases, may not be available in every country or state. Nano is provided “as is” and “as available”.
3. Your approvals and your responsibility
Nano sends email, creates calendar events and sends transactions only after you approve the exact action, for example by replying YES. You are responsible for reviewing each proposed action before you approve it and for the actions you approve, including the content and recipients of emails, the details and attendees of events, and the amount, asset and destination of transactions. Approving a draft does not authorize sending it. Once an email is sent, an event is created or a transaction is confirmed, we cannot recall it.
4. Your Solana wallet
- When you use Nano’s Solana features, Nano sets up a wallet for you. The wallet and the digital assets in it are yours. We do not lend, rehypothecate or otherwise use your digital assets.
- Some wallet features may be provided by third-party wallet infrastructure providers, whose terms also apply.
- Blockchain transactions are irreversible. If you approve a transaction to the wrong address or for the wrong amount, we cannot reverse it.
- Network fees are set by the Solana network, may change, and are shown before you approve where possible.
- Before you close your account, move your digital assets out of your wallet. We will tell you how to do this if you ask.
5. Buying crypto with Crossmint
Purchases of crypto with a debit or credit card, Apple Pay or Google Pay in Nano are provided by Crossmint and its partners, not by NanoLabs AI. When you buy crypto:
- You enter into the purchase with Crossmint under Crossmint’s Terms of Service and Privacy Policy, which you must accept before your first purchase.
- Crossmint will verify your identity (KYC) and may ask for more information, limit or decline a purchase, or close your access to its service under its own rules. Purchase limits apply and depend on your verification level and location.
- Before you confirm, you will see the amount you pay, the fees, and the amount of crypto you will receive. Prices of digital assets change quickly, and the final amount is set when the order is completed.
- The crypto is delivered to your Nano wallet. NanoLabs AI does not receive or hold your card payment and does not exchange fiat currency for crypto.
- You may only use a payment method that belongs to you, and only to buy crypto for your own wallet.
6. Refunds and failed purchases
- Crypto purchases are final once the crypto has been delivered to your wallet, because blockchain transactions cannot be reversed and prices change constantly.
- If a purchase fails, is declined, or the crypto is not delivered, the charge is not completed or is refunded to your original payment method by Crossmint or its payment processor. Refund timing depends on your bank or card issuer.
- If you think a purchase went wrong, contact us at support@nanobot.sh with the date and amount, and we will work with Crossmint to resolve it. Please contact us before disputing a charge with your bank.
- Nano itself is free during the beta. If we start charging for Nano, we will tell you the price and refund terms before you pay.
7. Digital asset risks
Digital assets are risky. Their prices can be volatile and can fall to zero. They are not bank deposits and are not insured by the FDIC, SIPC or any government. Laws that apply to them may change. Blockchain networks can fail, be congested or be attacked, and smart contracts and protocols that Nano helps you use can have bugs or be exploited. You could lose some or all of your digital assets. Only use funds you can afford to lose.
8. No financial advice
Nano is a personal assistant, not a broker, exchange, investment adviser or bank. Nothing Nano says, and nothing on our websites, is investment, financial, legal or tax advice, or a recommendation to buy, sell or hold any asset. You make your own decisions and are responsible for any taxes on your transactions.
9. $NANO and credits
The $NANO token and Nano credits described on our website have not launched. Descriptions of them are previews and may change. Nothing on our websites is an offer to sell, or a solicitation of an offer to buy, any token or security. If we launch them, separate terms will apply.
10. Acceptable use
You agree not to use Nano to:
- break the law or violate anyone’s rights, including privacy and intellectual property rights;
- launder money, finance terrorism, evade sanctions, commit fraud, or use funds that come from illegal activity;
- use Nano if you are located in, or a resident of, a country or region subject to comprehensive U.S. sanctions, or if you are on a sanctions list;
- send spam, bulk or unsolicited messages, or harass, threaten or deceive anyone;
- access accounts, wallets, payment methods or data you are not authorized to use;
- interfere with, probe, overload or reverse engineer Nano, or get around its limits or security; or
- generate content that is illegal or harmful, or that violates the usage policies of our providers.
We may suspend accounts that violate these rules, and we may report suspected illegal activity to the authorities.
11. Third-party services
Nano works with services we do not control, including Google (Gmail and Google Calendar), Apple iMessage, Crossmint, the Solana network, our messaging provider, and your mobile carrier. Your use of those services is governed by their own terms. They may change or become unavailable, and we are not responsible for them. Message and data rates from your carrier may apply.
12. AI output
Nano uses artificial intelligence, which can make mistakes. Its answers, summaries, drafts and proposed transactions may be incomplete, out of date or wrong. Check important information yourself, and do not rely on Nano for medical, legal, financial or other professional advice or for emergencies.
13. Your content
You keep ownership of the messages and content you provide. You give us permission to use it only to operate and provide Nano to you, as described in the Privacy Policy.
14. No warranty
To the fullest extent permitted by law, Nano is provided without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not promise that Nano will be uninterrupted, error-free or secure.
15. Limitation of liability
To the fullest extent permitted by law, NanoLabs AI will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, goodwill or digital assets, including losses from market movements, transactions you approved, blockchain or third-party failures, arising from your use of Nano. Our total liability for any claim relating to Nano is limited to the greater of the amount you paid us for Nano in the 12 months before the claim or US $50. Some jurisdictions do not allow these limits, so they may not apply to you.
16. Termination
You can stop using Nano and delete your account at any time, as described in the Privacy Policy. We may suspend or end your access at any time, for example if you violate these Terms, if the law requires it, or if we end the beta. If we end your access for a reason other than a violation or a legal requirement, we will give you a reasonable chance to move your digital assets out of your wallet. Sections 3 through 9 and 12 through 18 survive termination.
17. Changes
We may update these Terms. If we make material changes, we will update the effective date above and let you know through Nano or our website. If you keep using Nano after the changes take effect, you accept the updated Terms.
18. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules.
